Mandatory information
Legislation
Statistical confidentiality
All personal data obtained both directly from interviewees and through administrative sources will be protected and covered by statistical confidentiality. (art. 13.1 from the Statistic Function Public Law, May 9, 1989, (LFEP)). All individuals reporting statistical information shall be obliged to preserve statistical confidentiality (art. 17.1 of the LFEP).
Obligation to provide data
Laws 4/1990 and 13/1996 established the obligation to provide data that are required to complete this statistical data.
Statistical services may request data from all physical and legal persons national and foreign, residing in Spain (article 10.1 of the LFEP).
All individuals who provide data, whether their collaboration is mandatory or voluntary, must answer truthfully, accurately and completely and in due time the questions provided by the statistical services (LFEP art. 10.2).
Non-compliance of the obligations established by this law, in relation to statistics for governmental purposes, will result in sanctions in accordance with the provisions of this title (article 48.1 of the LFEP).
Very serious offences will be sanctioned with fines from 500,001 to 5,000,000 pesetas. Serious offences will be sanctioned with fines from 50,001 to 500,000 pesetas. Minor infractions will be sanctioned with fines from 10,000 to 50,000 pesetas (articles 51.1, 51.2 and 51.3 of the LFEP).
